Terms of Order
We recommend to print out all transaction data and the Terms and Conditions and to keep them at an easily accessible place.

All Prices are including VAT. All prices are not binding and flexible until the customer receives a confirmatin email from Mathias Gordon / recordsale.

additionally to the price of the ordered items, there is a shipping price which applies, and depends on the items, the shipping address of the customer and the payment method. The valid shipping prices are published on http://www.recordsale.de/eng/php/shipping.php?region=3 The total ammount is visible to the customer before sending the order by pressing the calculate button.

The contract between Mathias Gordon/recordsale and the customer is only valid after Mathias Gordon/recordsale confirmed the availability and price of the item ordered via email to the address provided by the customer. Most items in the catalogue are unique, so there is no possibility to claim the right to receive an item advertised, before receiving the confirmation.

Please do not send money before you have received a confirmation mail.

In the event that the delivered items differ considerably from the advertised condition, and the customer notifies Mathias Gordon/recordsale immedeatly after receiving the item. We will try to provide a substitute or refund your payment. Before we do that, we expect you to send the item back, including a short note what was wrong with the item.

We ensure to handle all private data you send us with confidentiality. This data will not be provided under any circumstances to third party persons/companies.

In the case of payment by mail, the customer takes full responsibility for money shipping

subsidiary agreement and additions to the contracts are not valid unless they are written and signed by Mathias Gordon.

Cancellation or altering the contract is possible until we received payment. Der Käufer hat nach Erhalt der Ware ohne Angabe von Gründen ein Rückgaberecht gemäß § 356 BGB. Das Rückgaberecht beträgt 1 Monat nach Erhalt der Ware. Liegt der Wert der Warensendung unter 40 Euro hat der Käufer die Ware auf seine Kosten an den Verkäufer zurückzusenden. Das Rückgaberecht ist ausgeschlossen, sofern die Versiegelung des Tonträgers entfernt oder beschädigt worden ist.

The customer has the possibilty to pick up the items personally at the given address. The shipping will be handeled by Deutsche Post AG, heavy cardboard packaging will be used. The shippig risk is assigned to the customer as soon as the item reaches the postal service.

For this terms of order as well as entire privity of contract between ‚Mathias Gordon / recordsale' and the customer , it is the law of Federal German Republic which is assigned. Other national legislations and Un-customer rights are excluded. Place of jurisdiction is Berlin/Germany. Should any clause in these terms of order be invalid , it will not do any harm to the rest of the contract.

Due to the german tax law and the arrangements for second hand vendors ‚Mathias Gordon / recordsale' cannot issue invoices with designated V.A.T. for second hand items.

We do not take warranty for the pictures illustrating the products, there may be differences to the purchased product.

In cases of account purchases the items will remain property of Mathias Gordon/recordsale until payment has been completely received

The warranty on the items will be valid for used items after one year and on new items after two years. Does the customer assert guarantee, he has do send the goods back to the seller in original packaging. The seller decides at the inspection of the returned items, to accept or not accept the claim on the warranty. There is no warranty for damages which have been described in the grading of a used product.We point out explicitly that it is common issue that used records and CDs can lack in quality due to dirt or lack of quality of the player used. The Seller cannot be made responsible for this.

An item, which is advertised as 'Still Sealed' is in an unused item delivered from a gross sale market or the publisher directly. Depending on the gross sale or the publisher it may not be sealed, but the item is still brand new and without any damage.
